MySawStop Terms of Use

  1. General terms and conditions and registration
    1. MySawStop is an online service offered by TTS Europe SE (hereinafter referred to as “SawStop Europe“) as a distribution partner of SawStop US in Europe, which offers you various applications. SawStop Europe provides you with these services free of charge.
    2. By registering with MySawStop, you open a user account under which you can receive up-to-date product information and use the applications offered by SawStop Europe. By registering with MySawStop, you agree to these Terms of Use and accept the Privacy Policy (available at Privacy Policy  ). In the event of a breach of these Terms of Use, we are authorised to delete your MySawStop account immediately and without further warning. The same applies if one of your actions is likely to impair the proper functioning of the SawStop websites or the SawStop infrastructure.
    3. To register, we need your first and last name, your email address, a password of your choice and information as to whether you use the account commercially (with company name) or privately. If you want to use our other MySawStop applications, it may be necessary for you to provide additional personal data (e.g. address). Further information on this can be found in section 4.
    4. You must set a personalised password when you register. Keep your password safe and inaccessible to third parties. Do not give your password to any third party.
    5. You can terminate your user account at any time and without giving reasons. To do this, please log into your MySawStop account and click on the “Delete MySawStop account” link in the “My profile” section.
    6. SawStop Europe reserves the right to amend, change or delete these Terms of Use and/or individual applications under MySawStop in whole or in part without giving reasons and without prior notification to the users.
  2. MySawStop applications
    1. The option to use the applications offered by MySawStop does not constitute an offer on the part of SawStop Europe, but only an invitation to submit an offer. By clicking on the respective confirmation button, you submit an offer for using the respective service. SawStop Europe only accepts the offer upon express acceptance by SawStop Europe or the provision of corresponding services, and only upon such acceptance does a contract between the user and SawStop Europe (or a company affiliated with SawStop Europe) come into existence.
    2. Applications currently offered by SawStop Europe are:
      1. Tool management
        • Registration of saws/machines for warranty purposes incl. invoice upload
        • Registration saws/machines without warranty
        • Deletion of registered saws/machines
        • Repair assignments
        • Overview of the registered saws/machines
      2. Registration for receipt of report on safety release
      3. Registration for receipt of advertising
      4. participation in prize competitions and other events.
  3. Responsibility for user content/data and/or information, availability
    1. You are obligated,
      1. to provide only true and non-misleading information and not to use pseudonyms or stage names;
      2. to observe the applicable legal provisions and the rights of third parties when using MySawStop and the content on MySawStop. In particular, you are prohibited from using the website or its content for illegal, pornographic, obscene, defamatory or infringing purposes;
      3. to ensure that appropriate security measures and virus scanners are in place before downloading material provided by SawStop Europe for your own protection and to prevent viruses on the SawStop Europe website.
    2. SawStop Europe accepts no responsibility for the data you provide.
    3. You hereby acknowledge that a 100% availability of the website is not technically feasible; however, SawStop Europe endeavours to keep the availability of the website as constant as possible. Disruptions may nevertheless occur due to maintenance, safety or capacity issues.
    4. SawStop Europe shall be liable without limitation for damages arising from the infringement of a guarantee or from injury to life, limb or health. Liability for the material provided by SawStop Europe being free of material defects and defects of title, in particular for the absence of errors, correctness, non-encumbrance by third-party property rights and copyrights, completeness and/or usability is excluded. This shall not apply if such defects are due to intent, gross negligence or fraudulent intent. Claims for damages by the user, for whatever legal reason, in particular for breach of contract, are excluded. This does not apply in cases of intent, gross negligence, absence of warranted characteristics and under the Product Liability Act [ProdHaftG]. Liability for consequential damages is excluded between the parties.
  4. Data protection
    1. The personal data that we received when you opened your MySawStop account will be stored, processed or used exclusively for the use of the applications offered, unless you have consented to other purposes.
      1. Registration: As part of the registration process, we store and process your email address and other mandatory information. The legal basis for this is Art. 6 para. 1 lit. b) GDPR.
      2. Machine registration: To assert a warranty claim for your saws/machines, you must provide us with your first name, last name, postal address and email address. The legal basis for this is Art. 6 para. 1 lit. b) GDPR.
      3. Safety release report: To receive reports on safety releases for your saw/machine, it is necessary that you provide us with your first and last name, your postal address, email address, machine data and the date of the safety release. The legal basis for this is Art. 6 Ab. 1 lit. a) GDPR.
      4. Advertising: In order to provide you with information material, we require your email address and/or postal address as well as any other personal data (e.g. last name, first name). The legal basis for this is Art. 6 para. 1 lit. a) GDPR.
      5. Prize competitions: In order to organise prize competitions, it is necessary for you to provide us with the personal data requested in this context, e.g. first name and last name, postal address. The legal basis for this is Art. 6 para. 1 lit. a) GDPR.
      6. Participation in events: To be able to organise planned events, we process the necessary personal data, e.g. first name and last name, email address. The legal basis for this is Art. 6 para. 1 lit. b) GDPR.
    2. If you provide us with information for the use of an application and this data has not yet been saved in your profile, it will be automatically transferred there and then generated from your profile when you use the application again.
    3. Your data will be stored until you withdraw your consent to this or erased in the context of the deletion of your MySawStop account.
    4. All data is used and processed by SawStop Europe. Your personal data will not be transferred to third parties unless this is necessary for the purpose of implementing the respective application. Further information on data protection can be found in our privacy policy: Privacy Policy.
  5. Final provisions
    1. To update your customer data, SawStop Europe asks you to enter any changes in your free MySawStop account at sawstop.eu without delay. SawStop Europe cannot assume any additional costs incurred due to outdated customer data.
    2. The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
    3. The exclusive place of jurisdiction for all disputes arising from or in connection with a MySawStop account is the registered office of SawStop Europe (TTS Europe SE).
    4. Should any provision of these Terms of Use be or become invalid or unenforceable in whole or in part, or should there be a loophole in these Terms of Use, this shall not affect the validity of the remaining provisions. In place of the invalid or unenforceable provision, the valid or enforceable provision that comes closest to the purpose of the invalid or unenforceable provision shall be deemed to have been agreed. In the event of a loophole, the provision that corresponds to what would have been agreed in accordance with the purpose of these Terms of Use shall be deemed to have been agreed.
